民事公益诉讼在我国属于近年来刚刚在实践中发展起来的新现象,就整体而言,民事公益诉讼在我国发展的关键之一,是必须以重新审视法院的功能为起点,扩展民事诉讼机能。深入分析民事诉讼机能与民事公益诉讼之间的关系,民事诉讼机能的扩张是民事公益诉讼发展的制度基础,民事公益诉讼呼唤相应的民事诉讼机能。

Key words In recent years, civil public-interest action, as a new phenomenon, has just come forth in China＇s judicial practice. As a whole, the key to develop civil public-interest action in China is to reconsider the function of the court and then to expand the function of civil action. The relationships between functions of civil action and civil public interest action, point out that functional expansion of civil action provides institutional space for the development of civil public interest action,and corresponding kind of function of civil action is required by the civil public interest action.
