法国人权保护中的司法功能

Judicial Function in the Protection of Human Rights in France

当今世界的人权基本问题是如何使人权变得有效,法国在这方面提供了实施人权多元保护的范例。在法国,承担司法功能的主体包括普通法院、行政法院和宪法委员会等,相应地,人权的司法保护存在普通司法、行政司法和立法审查三类基本途径。此外,欧洲区域法院也为法国的人权保护提供了另一司法途径。法国的人权司法实践值得我们深思。

Today in France the judicial practice illustrates that its basic problem is to make human rights effective. Because the subjects of judicial function include ordinary court, administrative court and constitutional council, there are three types of judicial protection of human rights in France, that is, ordinary judicial protection, administrative judicial safeguard and legislative review. Besides, regional courts of Europe provide another judicial protection of human rights. The example of France is worth of our speculation in modem China.
