文章从法学社会学的角度对作为实践问题的离婚财产分割进行了分析。在比较两大法系相关领域的法制经验及其社会背景的基础上,指出离婚财产分割中规则和裁量应当互相平衡,同时它们之间具体的结构和地位则依据各国的具体情况具体对待。对于我国来说,基于我国的现状和国情既需要完善规则,又要完善、规范裁量权,使两者之间形成良性互动。

The divorce property＇s division is analyzed from the angle of law sociology in this article. On the basis of comparing the legal system of department＇s relevant fields of two fundamental laws and its social background, it points out that the adjudication and the rule in divorce property＇s division should be balanced to each other, and their concrete structure and status should be different according to various countries＇ conditions. In our country, on the basis of the current situation and national conditions, we not only need to improve the rule, but also empower the fight of adjudication. So it＇ll form positive interaction.
