On the Theory of Interests Balancing in Modern Legislative Process

在现代社会中,随着社会利益结构的变迁,多元利益共生于同一场域共同争夺着稀缺的资源,面对利益冲突,现代立法的利益调控功能日显重要。现代立法其实质是一个利益识别、利益选择、利益整合的交涉过程。当代我国立法中的利益衡量应当依据一定的标准和原则。

In the modern society, with the changes of the social interests structure, plural interests are grown and fought for rare resources in the same field. Facing the interest conflict, the function of interest regulation is becoming more important to the modern legislation. The essence of modern legislation is a negotiation process of the qualification, choice and integration of interests. It should be in accordance with certain standard and principle in modern legislative process.
