我国法律名称及其术语的归化英译

Naturalization in Chinese-English Translation of Titles and Terms Concerning Chinese Law

法律名称及其术语英译和英美法律汉译,对于提倡和推广法律法规的归化翻译,推动我国经济发展和法制建设有着较强的现实意义,是一个十分重要的研究课题。文章从当前我国法律名称及术语英译过程中出现的一些问题,如直译、望文生义等现象入手,提出了如何规范我国法律名称及其术语等措施。

For a long time the legal translation, from Chinese into English and vice versa, has been a problem for Chinese people and English-speaking people to understand each other＇s legal language translated especially in the aspects of title and its legal terms＇ inter-translation. The reasons lie in firstly the different attitudes and approaches of legal translation itself： ＂naturalism＂ and ＂dissimilation＂. So, to regard highly the importance of nourishing and training the experts of compound knowledge of law and language is the fundamental measures that our government take to improve the influence of our legal system and know better of the common law system to protect the benefits of the enterprises and our country as a whole.
