对我国建立非法证据排除规则的理性思考

目前,非法证据排除规则已成为世界各国通行的刑事诉讼的采证规则之一,但由于多方面因素的影响,我国对于非法证据排除规则在立法上并没有明确规定,非法证据排除规则在我国的确立也面临重重困难。但是,根据国际刑事司法发展的趋势,以及现代法治的渴求,在我国确立非法证据排除规则是势在必行的事。
