刑罚的流变可以概括为报复刑时代、刑罚威吓时代、社会防卫时代。它对我国当前刑事控制模式的选择具有重要的借鉴意义。历史上的刑事控制模式有两种:刑罚威吓模式和社会防卫模式。我国刑事控制模式应分为近期模式和长远模式。近期(社会转型期)模式应采用刑罚威吓模式和社会防卫并重模式。长远(社会转型完成之后)模式应实行社会防卫为主,刑罚威吓为辅的模式。
