立足现有国情,紧缩死刑的适用范围

Reduce the Application Scope of Death Penalty According to Our Practical Situation

当代国际社会死刑的发展有两种流行趋势:一是完全废除死刑;二是在保留死刑的基础上严格限制并逐步减少死刑适用。在我国,一方面,死刑文化有着较深厚的群众基础及认同心理;另一方面,我国正处于社会转型期,各种社会矛盾凸现,犯罪增加,盼望以重刑尤其是死刑换取安全感的思想有较高的民众认同范围。笔者认为应当理性对待死刑所起到的作用,紧缩死刑的适用范围,严格限制死刑并逐步废除死刑。

There are two tendaeies for the development of international death penalty： abolish it completely; remain it but limit it strictly and reduce its application scope. In our country, there are two factors that make people be identified with the death penalty ： it has a large amount of people to be the identity basis; a series of social problems and crimes are emerged in reneent years. In this paper, the author suggests that we should be sensible to make use of the death penalty; reduce its application scope and limit it strictly till aboish it gradually.
