浅析建筑作品的著作权保护

On the copyright protection of architectural works

建筑作品具有实用性、艺术性和科学技术性的综合特点,与其他一般作品相比,其著作权问题具有较多的特殊性。运用著作权制度的基本原理,探讨建筑作品著作权保护的范围、建筑作品著作权保护的适用条件以及建筑作品的著作人身权和财产权等内容,初步构建起建筑作品著作权制度的理论框架。

Compared with other ordinary works, architectural works appear much extraordinary in intellectual property due to their pragmatic, artistic, scientific and technological characteristics. The thesis, applying the basic principles of copyright, explores the scope of architectural works, the condition of application, various moral rights and economic rights of the copyright of architectural works. The author intends to construct the initial theory frame of architectural works＇ copyright system.
