摘要
《植物新品种保护公约》是保护植物育种者权益的重要国际协定。它的产生既是生物科学技术发展和育种科技成果商业化的必然要求,也是国际育种业利益调整的现实选择。其主要的法律基础在于保护育种者的合法权益,推进育种业科技的可持续创新。《植物新品种保护公约》虽然存在一定的局限性,但在保护育种者权益,协调育种者和用户之间的利益方面具有相当的可行性,而且在技术方面能有效地解决新品种认定的难题,因此是当前各缔约国默认的“有效制度”。
The Convention on the Protection of New Plant Varieties is an important international agreement for protecting the rights of breeders. It is the result of the development of biotechnology and commerciahzation of plant varieties, as well as the adjustment of interest of international seed industry. It aims at protecting the rights of breeders and promoting the innovation of plant breeding. Although there still be some insufficiency in UPOV, it has its own strongpoint in the protection of breeders＇ interest and harmonization the relationship between breeders and users. Furthermore, it also resolved technological difficulties in the identification of new plant varieties. Therefore, UPOV has been considered as the effective regime by its members.
