试析作为民国议和代表与司法总长伍廷芳的贡献

WU Ting-fang as the Representative of the Peace Negotiations and the Minister of Judicature of the Republic of China

伍廷芳在确定共和民主制度的南北议和中有很大贡献。同时他在南京临时政府司法总长任内先后办理的姚荣泽、宋汉章两案,为诉讼法制和行政法制的近代化做了大量的工作。以前对伍廷芳研究的谬误应是由相关论著在史料和史评上的失误造成的。

The contribution in the negotiations between the the Qing government and the Republic of China which result in the establishment of the democratic and republic system and the two legal cases of YAO Rong- ze and SONG han - zhang handled by him during his term as the minister of judicature of the Republic of China indicate WU Ting- fang＇ s achievement in modernization of Chinese procedural and administrative legal institutions.
