简论凉山彝族的“德古”调解制度

A Brief Discussion on Degu Conciliation System of Yizu in Liangshan Atonomous Prefecture

凉山彝族“德古”调解制度已有数千年的历史,至今在彝族人的法律生活中还发挥着重要作用。本文根据作者田野工作获得的案例进行了分析,展示出“德古”在解纷中对规范运用的充满人性的真实过程,德古们高超地融情、理、法于一体的法律艺术,出色地维护了彝区的社会秩序,不仅表明德古制度的重要功能,同时也揭示出彝族人的法律智慧及其创造性的精神价值,这对于当代司法制度改革富有极大的启示。

Degu Conciliation System of Yizu in Liangshan Atonomous Prefecture, Sichuan Province , with a history of thousands years, has also play an important role in Yizu＇ s legal life. This dissertation, based on cases of field work , shows Degu＇ s reasoning in the phase of disputes resolution, as weli as their superb legal skills, which make feelings, reasonings and laws in perfect harmony. Today＇ s judicial reform should draw inspiration form Degu Conciliation System, which gives key play to social order in Yizu inhabitant areas and also shows legal wisdom and creativity of Yizu people.
