Patent pool is an important institution of intellectual property and has great impact on competition policy. In this paper, firstly several concepts about patent pool are introduced, secondly the competitive effect of patent pool is analyzed in details, then the antitrust history of patent pool in the U.S. is reviewed, and lastly the criteria of setting up patent pool is summarized.
