视听资料可采性初探

On the Admissibility of Audio-visual Materials

视听资料是一种较新的证据形式,虽然我国三大诉讼法都已经确立了其独立的法律地位,但是立法规范过于简略,导致司法实践中缺乏可操作性规范进行调整。首先对域外有关视听资料可采性的规定进行梳理,结合我国现有的视听资料可采性的规定及其存在的不足,对完善我国的视听资料可采性提出自己的认识,以期对司法实践有所裨益。

Audio - visual materials are a relatively new form of evidence. Although its independent legal status has been confirmed in the three major procedure laws of China, legal regulations about it remain too simple to be operable in legal practice. After reviewing the regulations on the admissibility of audio - visual materials in other countries, this paper discusses such regulations in China and some existing problems and then proposes some suggestions on how to improve the admissibility of audio - visual materials in China.
