摘要
惩罚性赔偿制度作为一般民事赔偿制度的例外,在英美法系得到普遍的承认。我国的《消费者权益保护法》第49条对此制度也有所涉及。本文在对惩罚性赔偿制度分析之后,对我国《消费者权益保护法》第49条的适用条件等进行探讨,并针对当前该法所引起的一些问题提出解决办法,以期对该条在司法实践中的适用有所帮助。
