本文从国家赔偿的性质、范围、精神损害赔偿的内涵及我国有关精神损害赔偿的法律规定入手,对完善国家赔偿中精神损害赔偿的必要性进行了阐述,并从扩大精神损害的国家赔偿范围、提高国家赔偿标准、拓宽国家赔偿原则等方面尝试提出几点立法建议。

This article leadoffs from the nature of Compesation, scope and the connotation of compensation for mental damages and the spirit of laws, and expounds on the necessity of improving the national compensation for mental damages, and from the spects expects expanding the extent of the national compenstion for mental damges, raising the ntional standard of compensation, broadening ntional compensation principles, puts forward several suggestion on legislation.
