从价值取向审视《物权法》草案中土地承包经营权的移转

摘要 《物权法》草案出台后,关于农村土地承包经营权方面的立法争论十分激烈。农用地方面的立法如何立足于中国农村社会的现状,适应农业市场化的现实、迎接国际经济的严峻挑战是迄今立法者须着重考量的问题。笔者从土地承包经营权移转的两级市场出发,从价值取向审视《物权法》中这方面的立法,力图在公平与效益中寻找一个平衡支点,在一级市场即土地承包经营权的第一次移转上体现以公平作为首要的价值目标,兼顾效益;在权利流转的二级市场上体现效益优先,兼顾公平的价值理念。 After the draft of Property Law being formulated, the legislation argument about the rural land contract right of management is extremely heated. This paper begins with the two levelled markets of shifting land contract right of management and examines the legislation of Property Law from the perspective of value orientation, thus seeking balancedpivot between fairness and benefits. Meanwhile, in the first leveled market, namely, the first shift of the land contract right of management, in which fairness as the primary value goal is reflected, giving consideration to benefits; while in the second levelled market of right- shifting, in which the value concept of priority to benefits is reflected, giving consideration to fairness.
