Discussion on improvement for practice of guaranteed pending trial of public security organ

目前,公安机关取保候审在适用理由、保证方式及执行等方面的法律规定存在相当程度的背离。解决公安机关取保候审存在的问题,应充分考虑现阶段能够实际改进的程度,兼顾“程序正义”理念的贯彻,立法上进一步明确取保候审的适用理由,细化没收保证金的条件、程序,落实保证人的责任,推行双重保证,并加强对被取保候审者的监管。

Based on the practice of guaranteed pending trial of the public security organ,its operation is revealed and reviewed in terms of application conditions,guarantee modes and so on.Thereby ,it is tried to improve the path of guaranteed pending trial not only to indicate the theoretical guidance to some degree,but also to accord with the real reform trend of criminal procedure law.
