Folk law, the crystallization of people＇s thinking and emotion, makes up ＂the vacuum＂ left behind by national law, enriches the controlling system of the society and has a high sense of self-identity. Folk law facilitates and economizes mediation. After approved and absorbed by the national legislature, folk law can transform into national law; consequently, it can impel the construction of the legal society and the formation of people＇s belief in law in China. Folk contract is one of important expressive ways of folk law and a kind of ＂universal judging standard＂ or generalized ＂legal origin＂. As a form of folk contract with nationally traditional characteristics, the partnership contract of the salt industry belongs to the field of folk law. Analyzing its concrete content, historical function as well as folk characteristics will help people know how to give proper living space to folk law today when national law is dominant; thus it will provide theoretical research on China＇ s law with helpful systematic resources.
