我国村规民约的功能与法治考量

村规民约是我国农村改革开放中大量存在的一种具有中国特色的公共管理制度,它的出现是中国社会转型的必然产物。在依法治国的条件下,村规民约应当在有法可依的范围内严格遵守法律,可以在无法可依的空白区作出合理规定,还必须建立对村规民约合法性的监督审查机制。

Civilian regulations for the countrymen can be a sort of public management system with Chinese character, which is established in the country reform and opening of China. It is the result of the China social transformation. Under the condition of managing the state affairs by the law, these regulations must strictly comply with the state law in the domain of the dependent law and reasonably work out stipulations in the vacancy of the independent law and the valid supervised censor system about the civilian regulations should be constituted.
