Rational Construction of Purpose of Penalty

传统的刑罚目的理论正在面临着愈来愈多的挑战。刑罚目的可作如下划分,即:以刑罚作为刑法的下位概念为基础,在横向层次上,将刑罚目的划分为主要目的(惩罚犯罪)和次要目的(预防犯罪)两个层次,此为狭义的刑罚目的之理性建构;在纵向层次上,将刑罚目的划分为第一层次惩罚犯罪与预防犯罪(直接目的)——第二层次保护法益(根本目的)两个存在递进深入关系的层次,此为广义的刑罚目的之理性建构。

The traditional theory of purpose nf penahy is being challenged. Purpose of penalty can be divided into two kinds. In the horizontal level, it ean be divided intn main purpose（punishing crime） and subordinate purposel preventing crime）.This is rational construction of purpose of penahy in narrow sense .In the vertical level .it can be divided into two gradational levels. Namely, the first level： punishment of crime and prevention of crime （direct purpose）--the second level： protection of legal interests. This is rational construction of purpose of penalty in broad sense.
