商业贿赂犯罪的认定与法定刑完善

Improvement on the Commercial Bribe Crime's Condemnation and Penalty

为了有效惩治商业贿赂犯罪,笔者建议:将国家工作人员的经济受贿犯罪规定为纳入商业贿赂犯罪中的经济受贿罪;增设非营利性组织、中介组织人员受贿罪;适当扩大商业贿赂行为所涵盖的范围;对商业贿赂犯罪法定刑加以调整,以实现与公务贿赂犯罪法定刑的协调统一。

In order to punish the commercial bribe crime, the author suggests that public officer＇ s bribe crime in business be considered as commercial bribe crime, staff member＇ s bribe crime in non-profitable or intermediary organization be set up, extend of commercial bribe crime be expanded and penalty against commercial bribe crime be adjusted.
