中美商业秘密侵权救济制度比较研究

A Research on the Comparison of the Trade Secret Restatement Rescue Institution Between China and the USA

在发达国家中,美国的商业秘密保护水平较高,其侵权救济制度较为完善,在实际操作中能够对商业秘密权利人进行充分、有效地保护,非常值得我国借鉴。本文运用比较研究的方法,对中美两国商业秘密侵权的救济措施进行了全面地分析,找出我国目前商业秘密侵权救济制度存在的不足,并对完善我国商业秘密保护法律制度提出了具体建议。

Among the advanced countries, the US is on a higher level for trade secret protection,whose restatement rescue institution is better than others, and trade secret owners are protected sufficiently and effectively, which is a good example for our country. By the way of a comparative method, the paper analyzes the rescue measures in both China and the US, finds the disadvantages of the current trade secret restatement rescue institution in China and proposes some objective suggestions for the completeness of the trade secret protection law system in China.
