摘要 药品专利强制许可是平衡专利权人利益和公共健康利益的重要手段。TRI PS协议对如何实施药品专利强制许可作出了较为详细的规定,但国家在实施药品专利强制许可时依然面临着TRI PS协议不尽完善的法律问题以及实施强制许可之后所面临的政治、经济、外交压力与仿制药品药效通常不及原来的专利药品等现实问题。审慎实施药品专利强制许可,有利于振兴本国医药产业和维护公共健康利益。 Compulsory licensing for patented medicine is an important approach to balane the interests of patentees and public health. There are specific regulations on implementing compulsory licensing for patented medicine in TRIPS Agreement. However, the problems that face our government while implementing compulsory licenses include the ambiguous regulations of TRIPS Agreement, the political, economical and diplomatic pressures and poor therapeutic effect of the imitated medicine. Compulsory licensing related to patented medicine has to be implemented prudently so that it can benefit the development of national pharmaceutical industry and public health conditions.
