摘要
当前劳动者权益被侵害的现象比较严重。引发劳动者权益被侵害的原因可归纳为:劳动者与企业进行工资、劳动条件等"讨价还价"时,处于极不平衡的地位;我国政府运用法律制度来规范劳动关系,尤其是约束企业、保障劳动者权益的力度还很不够;一些地方政府不能保证和维护劳动法律制度的有效贯彻执行;劳动保障监察部门人力、资金不够、工作方式单一;代表劳动者集体利益的工会组织尚未全面普及,而现有的工会又缺乏独立性。为解决这些问题,应健全和完善法律制度,加强劳动监察保护力量,改进劳动监察保护工作方式,改进劳动争议解决机制。同时,还要引导工会发挥依法维权的机能,加大对劳动者的职业培训,创造舆论监督环境。
The labor rights are severely violating in China. This paper summarized these causes as the labor's weak position in negotiating salary or work condition with employer; the lack of strength in regulating enterprise behaviors and protection of labor rights ; there are a few local governments that could not properly execute the laws; the labor agencies have not enough of manpower, budgets and methods; labor union is not yet established in all of companies and industries, many existing unions are lack of independency. To improving such conditions, firstly we must reform laws and institutions, strengthen monitoring, refine the methods and built appropriate mechanism to solve labor dispute. Meanwhile we must guide unions to act for protecting their rights, training worker with skills and built a social media-auditioning environment.
