摘要
随着我国住房制度改革的商品化,物业管理纠纷日益增多。应从物权法的角度,首先明确物业管理的物权基础和物业管理的实质,然后在正本清源的基础上,提出解决物业管理问题的对策,如明确业主的“物权享有者”地位,物业公司的“服务者”角色等。
Along with the commercialization of housing system reform, the disputes of estate management have been increasing day by day. In order to cope with these disputes, in accordance with Real Rights Law, we should first make clear the real right foundation and the essence of estate management, then on the basis of radical reform, put forward the countermeasures to solve the problems in estate management, such as the proprietor" status of "enjoying real rights", the estate company's "service" role and the "lord and servant" relationship between proprietor and estate company.
