摘要
预告登记对应于本登记,在本登记之前,即赋予债权请求权以物权效力,成为债权之间的桥梁,保护了己订立合同却暂时难以进行本登记的不动产权利受让人的利益,填补了债权与物权之间的空隙,使民法的体系得以顺畅发挥功能。不动产预告登记制度在我国是一种较新的登记模式,在大陆法系国家则是一项比较成熟的物权制度,尽管如此,由于立法背景不同,各国的预告登记制度还是有一定的不同,其中尤以德国、日本以及我国台湾地区最为典型。
Advance notice registration is corresponding to registration, endows obligatory claim right with property right before registration, is the bridge between claim right and property right. It protects the purchasers, who have already contracted with the bargainer and have difficultly in registration temporarily, fills up the interspaces between claim right and property right, makes civil law bring into full play successfully. Advance notice registration system of estate is a novel registration mode in our country,but is a comparatively ripe property system in countries of continent law. Still, because of the different legislation background, advance notice registration in every country is different, Germany,Japan and Taiwan are especially typical.
