摘要
与其他诉讼方式相比较,代表人诉讼以其突出的优点更能有效地解决涉案人数众多的证券民事赔偿案件。人数不确定的代表人诉讼所特有的公告、登记程序以及判决的间接扩张力,使它能够最大限度地发挥代表人诉讼制度的功能,因此不应将其排除在证券民事赔偿的诉讼方式之外。同时,为了进一步完善代表人诉讼,应该扩大代表人诉讼的适用范围和诉讼代表人的权限,加强律师和法官在诉讼中的作用。
Compared with other action forms, representative action is able to dell with civil compensation lawsuit of securities successfully . One style of representative action, litigants are not fixed when they go to court. This style has some unique process such as affiche, register and the indirect expansile force of its decree, With these merits, it can bring the function of representative action into play. Thus it should be one of action forms in securities lawsuit . Furthermore , in order to perfect representative action, we should enlarge the scope and the right of lawsuit representative, reinforce the effect of attorney and judge in lawsuit.
