摘要
分析了目前医患关系的现状及成因,提出了完善处理医患纠纷法律的必要性及立法的一些建议:(1)民法适用于医疗纠纷调处的困惑;(2)完善医疗卫生操作规程和技术标准;(3)正视医疗纠纷处理的专业性;(4)强化医疗争议的法定调查;(5)医患纠纷处理的法制化;(6)医疗过失的判定要结合当时当地的实际情况;(7)控制过高额的赔偿;(8)建立医疗风险的保险机制。
To analyze the authar the present status of doctor-patient relationship and the cause of its formation.On the base of analyzing, to discuss the necessary of the legal solution of the doctor.patient relationship and gave some suggestions about the related law making： （1） The dilemma of using the civil law to handle the medical treatment dispute. （2） Completing and formalizing the medical treatment operation regulations and the technical standards. （3） Envisaging the specialties of resolving ＇the medical treatment dispute. （4） Intensifying the legal investment in resolving the medical treatment dispute. （5） Legalization in handling the medical treatment dispute. （6） Taking into account the real situation when judging the medical defect. （7） Restricting the over-high cor＇npensation for a medical malpractice. （8） Setting up the insurance system related to the medical treatment risk .
