The Connection between International Labor Standard and Human Rights Protection of the Migrant Workers

与国际劳工标准相比,我国农民工人权保障在工会组织权利问题、平等就业权问题、集体谈判问题等方面还存在较大的差距,这些对农民工权益的保护形成了障碍。因此,完善有关人权和劳工权利方面的法律,切实保障农民工的合法权益,不仅是国际人权公约所要求的,也是加入世界贸易组织后面临社会条款问题,我们事先作好法律准备所必须的。

Compared with the international labor standards, there are still enormous disparity between the human rights protection of the migrant workers in china, such as the issues on the labor union＇ s freedom of association, the fight of equal employment and occupation, the collective bargaining, et al. All of those problems are the barriers to the legal rights protection of the migrant workers. It is essencial to consummate the laws related to human rights and labor rights which is not only required by the international human rights conventions but also is confronted with the ＂social clause＂ issues after china entered into the WTO.
