中国宪法学的范畴体系探析

宪法学的范畴是人们的思维对宪法学的研究对象(宪法现象)的普遍的或本质的概括反映。研究我国宪法学范畴体系的归类、层次、结构以及核心范畴不仅对建立宪法学的科学体系、丰富宪法学内容具有重要意义,而且对于人们认识宪法现象,抽象和概括出新范畴,发展宪法学具有重要的理论价值。权力和权利是宪法学范畴体系中的一对核心范畴,也是其中最基本的范畴。

The category of the study of constitution is the general or natural reflection of the people＇s mind on the subject of the study of the constitution （the constitutional phenomena）. The research in the classification, system, structure and the kennel category of the study of constitution in China is of great significance for the establishment of the scientific system of the study of constitution and the enrichment of the content of it and is of great theoretical value for the people＇s understanding of the constitutional phenomena, abstraction or summary of the new category and the development of the study of constitution. Power and right are the kennel category as well as the most basic category in the categorical system.
