公安机关办理劳动教养案件存在的问题及对策

Problems in the Public Security Organization's Dealing With Reeducation-through-labor Cases and Its Countermeasures

由于劳动教养制度本身存在立法上的缺陷,因此公安机关在办理劳动教养案件中存在对象不明确、被劳教者几乎不能救济、期限过长、先行羁押措施混乱等问题。就此问题,文章探讨了提高办理劳动教养案件质量的相关对策。

Due to the limitations of the reeducation- through- labor system itself, there are some problems when the public security organizations start on the case of reeducation- through- labor, such as： the objects are not clear; those being reeducated can hardly get social relief; period of being reeducated are excessively long; the measures of beforehand detainment are confusing. In accordance with these questions, the article probes into the relative countermeasures of improving the qualities of dealing with reeducation -throngh -labor cases.
