摘要
罚金刑的执行难是一个世界性难题,而罚金刑易科制度能使罚金刑得以变相执行从而促进罚金刑的发展完善。笔者从分析罚金刑易科的含义入手,通过对罚金刑易科制度的利弊评析,提出了在我国罚金刑易科应当采取的形式、标准及适用条件。
The implementation of criminal fine is difficult all over the world. The criminal fine exchanging institution could make it implemented to a great extent and improve the criminal fine. This thesis begins with the implication of criminal fine exchanging institution, then suggests what pattern, form, standard and condition suitable we should adopt for use of the criminal fine exchanging institution in China through comments on advantages and disadvantages of criminal fine exchanging imtitution.
