摘要
电力设施的资产移交是供电企业经常遇到的问题。就其法律性质而言,它是一种赠与合同关系,但在某些情形下是负义务(负担)的赠与。针对其法律性质和实践中常见的情形,从合同当事人(转让方)资格、合同约定应注意的问题两方面探索对其进行法律规制。
