集体林权制度改革中林地级差收益问题探讨

Discussion on Forestland Differential Profit in Reform of Collective Forest Property Right System

集体林权制度改革的核心是森林、林木、林地的权属归属和界定问题。作为基础生产资料的林地,客观存在着级差收益问题。客观分析林地存在级差收益的原因及其对均山承包工作的影响,评述林地调整和使用权流转问题,并提出落实政策;明确林地承包期限;规范林地使用费的收取、使用和管理;实现林地的有偿转让经营等具体解决问题的办法。并就林权的界定、级差收益的占有权、级差上交的办法所解决的问题及其所带来的好处进行了讨论。

The essentials of collective forest property right system reform are the property＇s belonging and demarcation of forest, timbem and forestland. Being the fundamental production material, the forestland exist the problem of differential profit as the matter of fact. Based on the reason and impact analysis, the paper proposes the solution to the problems which relate to forestland adjustment, use property flowing, clear contract period, standard charge, use and management of forestland, use expense, achieving compensable transformation.
