通过对某高速公路工程业主制定的《合同专用条款》及业主的具体实施情况对比,分析承包人在接受不平等的格式合同条款后加大了工程成本,加重了施工企业负担。所以投标人应重视标前评审工作,尽量将风险规避在投标文件中,建设主管部门要依法扼制不平等格式合同条款。

Through the comparison between the Special Contract Clauses laid down by the employer of a certain highway project and the actual implementation by the employer, this article analyzes that the engineering cost is greatly increased after the contractor accepts the unequal format contract clauses and the burden becomes heavier on the construction enterprise. So, the bidder should attach great importance to bid eval- uation before the opening of bids, and try to avoid risks in the bidding documents, the competent authorities （the employer） should check and eliminate unequal format contract clauses according to law.
