改革与完善中国农村宅基地法律制度势在必行或具有现实必要性。宅基地立法要兼顾农村宅基地的财产性与福利性,完善农民的宅基地使用权;要坚持保护耕地的原则、以人为本的原则、关注生态环境的原则。宅基地立法的具体对策与建议:建立健全宅基地法律法规体系;加强和完善宅基地管理的执法体制和手段建设;加强法制宣传,提高宅基地管理人员及农民的自觉守法意识。此外,还要抓紧制定国家《农村宅基地管理条例》。

It is necessary to reform and improve the legal system of rural homestead. The legislation should give consideration to the property and welfare, improve peasants＇ enjoyment of homestead. In addition, it should ad- here the principles of protecting land, human-oriented, and protecting the ecological environment. The article here brings out some proposals to establish the legal system, improve its management, strengthen the propaganda of legal system and enhance farmer＇s consciousness to obey the law. Furthermore, it is really urgent to formulate the national Rural Homestead administration Regulations.
