动漫产业是世界性“黄金产业”,与产业相关的专利保护尤其是外观设计专利保护非常重要。动漫产业的知识产权保护与其制作的阶段密切联系,后期阶段的衍生产品更为重要。选择外观设计专利保护衍生品不仅审查要求低,容易获得保护,而且又满足了保护严格的特点。在对动漫衍生品进行外观设计保护的同时,还应当加强对动漫的第一、二阶段产品的著作权保护,以及商标的保护。

Cartoon industry is a world wide ＂golden industry＂, and its patent protection, especially the protection of design patent, is very important. The protection for intellectual property of cartoon industry has close relationship with its producing phase; meanwhile, the derivative products in the late stage are more important. To choose design patent for protecting derivatives not only easily gains protection with low requirement on examination but also satisfies the strictness of protection. The brand protection and the copyright protection of cartoon products in the first and second stages should be enhanced when the design patent of cartoon derivatives are being protected.
