摘要
荀子所谓“礼者养也”,主要不是养民,而是养君。其思想的根本出发点和归宿,是在礼义基础上保证统治者享有特权的生活。荀子有些被称为具有民本、民权思想的说法,其实并不具有这样的思想。荀子提出隆礼重法,在他那里,在很大程度上,礼就是法,法就是礼;礼具有法的强制性,而法具有礼的“因人而施”的不平等性。两者的合而为一,是与一个真正的法治社会的要求背道而驰的。
When Xun Kuang said "convenance means maintenance", he was referring to the maintenance of the monarch,rather than the people. The purpose and goal of this idea is to ensure the privileges of the rulers. Some of Xun Kuang's ideas were described as people-oriented and democratic,but they are actually not. Xun Kuang proposed the idea of "emphasizing both convenance and law". He considered the two as one. According to Xun Kuang,convenance is as coercive as law,and law includes the same unequal elements as coercive. To combine these two runs contrary to the real requirement of a law-abiding society.
