This article tries to research some questions about the sexy crime in Qin and Han Dynasty based on both literature and unearthed documents and then points out that. In Qin and Han Dynasty, there had been scales of penalty concerning this kind of crime, and most of that had been inherited and developed by the subsequent law; Compared with he subsequent law （Tang law mainly）, the Qin and Han Dynasty has their own distinguished characteristics as to the punishment imposed on the sexy crime.
