长期以来,规范说一直是德、日等大陆法系国家关于证明责任分配的通说,对我国学术界产生了很大的影响,在立法中亦有体现。本文对其内容和规则进行了具体的阐述。但规范说偏重法律规定的外在形式,完全不考虑证明的难易及对权利救济的社会保护,影响了证明责任分配的公平、公正,引起了诸多批判,本文对此亦从理论和实例上进行了说明、探讨。

The alien theory of legal regulations has great influence on the academic world of our country. It is also reflected in our legislation. The paper expounds the regulations and points out the problems in the theory. It tries to discuss it both in theory and practice.
