摘要
《反分裂国家法》的法理内涵及其正当性与合宪性可从以下三个方面得到阐释和解读:一、维护国家主权和领土完整与反分裂立法的关系;二、坚持一个中国原则与台湾高度自治的关系;三、《反分裂国家法》所基于的宪政和法治基础。
In order to demonstrate the legitimacy and constitutionality of Anti-Secession Law, this thesis explains the legal theoretical meaning of Anti-Secession Law from such three aspects as： first, safeguarding China＇s sovereignty and territorial integrity and Anti-Secession Law; second, upholding the principle of one China and a high degree of autonomy of Taiwan; third, foundations of the constitutionalism and the rule of law of Anti-Secession Law.
