环境人格权刍议

On Environmental Personality Right

环境人格权是权利主体所固有的、以环境人格利益为客体的、维护主体人格完整所必备的权利,是一种社会性私权。它具有较丰富的内容,反映了时代的发展和社会的进步。我国民法应纳入环境人格权,通过规定环境侵权行为的民事责任及其认定,对环境侵权行为人进行制裁,以达到保护环境人格权的目的。

Environmental personality right is one of the socializing private rights which the subject of civil right possesses forever,which takes environmental personality benefit as the object, and which maintenances the subject＇s personality integrity. It has substantial content,reflects the time＇s development and social progress. In order to protect environmental personality right, our civil law should bring into line with it and carries on sanctions to the environmental tort - feasors by stipulating the civil liability of environmental delicts and its recognizing.
