国际航空运输电子客票法律适用的若干问题

On Legal Issues of E-tickets In International Air Transportation

1993年,世界上第一张电子客票在美国VALUEJET航空公司诞生。经过十几年的改进和发展,作为电子商务的典型代表,航空电子客票已成为世界各大航空公司客运凭证的主要销售手段。目前使用电子客票的航线已经扩展到了世界各地,甚至在某些国际航线上使用。根据国际航空运输协会(IATA)的规定,其所有成员航空公司必须在2007年年底之前100%实现乘客飞行旅行的无纸化。国际航空运输由于跨越不同法域,不可避免地会引起国家或地区间的法律冲突问题;随着电子客票在我国国际客运航线上的全面普及,由此引发的跨国合同纠纷也将会越来越多。本文拟就现在已经存在的国际航空运输电子合同的法律适用问题,以及将来可能发生的与国际航空电子客票相关的诉讼管辖权问题进行解析,希望能够促进该领域诸多法律冲突问题的解决。

Electronic ticketing （“e- ticketing”） is arguably the most critical commercial tool aimed at cutting rising costs in the airline industry since its first at VALUEJET Co,. in 1993. Now e -tickets are widely used almost all over the world. In the late of 2007, as IATA plans, all the traditional air tickets must be substituted by e -tickets. In transnational air transactions, the use of e - tickets might bring out additional troubles in private international law. So the author enumerates the issues about conflicts of law in this area and attempts to give some adviees from the dimension of private international law.
