摘要
现行《药品管理法》和《刑法》对假药的规定存在不一致现象,因此对假药的规定需要统一。尽管威胁健康和生命是假药的第一危害,但假药的道德、社会心态、商业风气等危害也丝毫不容忽视。治理假药是一个复杂的系统工程,需要采取多管齐下的综合性治理措施。
The definition of false drug in current Law on Drug Management and Criminal Law is not consistent. Hence, it should unify the definition of false drug. Though the heaviest hazard of false drug is to hurt health and life, its hurt to moral, social attitude and commercial atmosphere can not be ignored. Dealing with false drug is a complex systematic project and need comprehensive measures.
