摘要
刑事控制模式是目前我国理论界和司法实践中所面临的一个重大课题。我国科学的刑事控制模式应当以犯罪的相对性、刑罚的谦抑性和刑罚的经济性为基本理念,以新的刑罚目的论——统一说为理论依据。我国刑事控制模式的调整应逐步实行轻刑化,必须坚持刑罚威吓和社会防卫相结合的模式,必须坚持"两步走"战略。
The pattern of criminal control is a significant issue for the academic and judical practice in our country. The basic idea of China's pattern of criminal control should be the relativity of crime,penal self-restraining and economy. Its theoretical foundation should be new theory of penal aim——'the theory of unity of the penal aims'.This paper proposes the strategic measures in the adjustment of the pattern of criminal control.
