摘要
代理父母地位说和特别权力关系理论曾分别是普通法系和大陆法系国家高等学校校生法律关系的两种具有代表性的理论。这两种理论随着社会的发展由盛而衰或不断演变,在实践中对校生冲突的司法救济产生了重要影响。揭示国外校生法律关系发展历程,探寻校生冲突救济的演变规律,对于我国高等学校校生冲突的救济有着重要的借鉴意义。
