我国信息化法制建设的现状与建议

Status and Proposals of Informatization Legislation in China

信息化是一场变革,这场社会革命对现有的法律制度提出了三个方面的挑战:(1)与现有的书面形式法律制度矛盾;(2)增加了现有法律规范适用的不确定性;(3)产生了制定新法律的需求。现有的信息化相关法律制度虽然已经形成了初步框架,并正在发挥作用,但是仍然存在理论准备不足、立法布局不合理、电子证据制度缺失的问题。在近期完善信息化法律体系仍然应当以立法工作为重点,应加快制定《电信法》、《互联网内容净化法》、《信息网络安全法》、《个人信息保护法》和《电子政务法》。

We define the informatization as a social revolution, which challenges the existing legal system as follow., confliction with the existing law, uncertainty of existing legal provisions and demand for new laws. Although the framework of informatization legal system is being formed, there are some problems in the process to form the framework such as lack of theory preparation, unreasonable layout of legislations, lack of electronic evidence system. To perfect the informatization legal system, we suggest to focus on the legislation in Telecommunication Act, the Intemet Content Purgation Act, Information Network Security, Personal In- formation Protection and E-government Act in the nearest future.
