知识产权法的公共领域理论 被引量：53

摘要 公共领域是在知识产权法理论中被广泛使用的概念。公共领域与知识产权的保护范围关系密切。在英美法系国家,知识产权法中的公共领域理论是通过判例法发展的。从公共领域的角度认识知识产权法的理念和精神,是从更高的角度理解知识产权的制度价值和知识产权这一专有权的更深一层内涵所必需的。公共领域理论可以通过洛克理论加以分析并通过实证分析形式加以理解。
