对经济法在中国经济转型时期功能的思考

Reflection on the function of economic law in the period of Chinese economic transformation

经济法功能是经济法学的重要理论问题。针对在中国经济转型时期经济法功能的定位问题,运用了比较的方法进行研究,阐述了在中国西方现代经济法功能的失灵及其原因。同时指出,在中国经济转型时期,由于没有市场经济的高度发展,必须抛弃“规范政府调节经济、弥补市场经济不足”的经济法功能的定位,并将其确定为“界定经济主体地位、培育市场经济、消灭行政垄断”。

The function of economic law is important in the theoretical research on economic law . This paper focuses on the orientation of the function of economic law during the economic transition of our country with comparative method. It illustrates the failure of the function of economic law and then points out reasons for this. Finally , it get the conclusion that the function of economic law should be useful to identify the role of economic entity ,promote the development of market economy and eliminate the administrative monopoly, since the market economy is not fully developed in the period of the economical transition of our country. At the same time, it must be abandoned that the orientation of the function of economic law is to regulate the action of government adjusting the economy and make up for the failure of market economy.
